Terms and Conditions

These terms apply to any doctor, clinic, practice manager or authorised medical user applying to use the Dr Rob Health / Hallmark Precision Health Doctors Rooms platform. The platform is governed by the laws of Victoria, Australia.

1. Doctor responsibility

The doctor remains fully, personally and solely responsible for their own medical registration, insurance, clinical advice, diagnosis, treatment decisions, prescriptions, patient communication, consent, privacy compliance and legal obligations. Hallmark Precision Health provides the digital platform and administrative support only, and does not direct, supervise or control any doctor's clinical judgment. Every report, recommendation and piece of clinical content generated through the platform — including any automated or AI-assisted draft — must be personally reviewed and approved by the treating doctor before release; the doctor may never rely on an automated draft as a substitute for their own clinical review.

1A. Independent contractor status — no vicarious liability

Each doctor uses the platform as an independently practising, AHPRA-registered medical practitioner, engaged as a locum or sub-contractor. Nothing in these terms, and nothing about the platform's operation, creates an employment, partnership, joint-venture or agency relationship between the doctor and Hallmark Precision Health. The doctor is not held out as, and must not represent themselves as, an employee of Hallmark Precision Health. The doctor is solely liable for their own clinical acts and omissions, and Hallmark Precision Health does not accept vicarious liability for them.

1B. Medical indemnity insurance

The doctor must hold, and keep current at all times while using the platform, their own professional medical indemnity insurance covering their clinical practice conducted through the platform, and must provide evidence of that cover on request.

2. Patient safety

The doctor must act in the patient’s best interests, avoid harm, review all patient information carefully and must not release automated, AI-assisted, draft or template recommendations without proper professional review.

3. Privacy and patient records

The doctor must protect patient information, keep logins secure, use only authorised systems and comply with Australian privacy, health records and professional conduct requirements. Patient information must not be shared with another doctor room unless lawful consent and authorisation exist.

4. Zedmed and booking systems

Each approved doctor is added progressively to Hallmark Precision Health Clinic's Zedmed account with their own authorised practitioner profile, secure login, schedule, provider details and billing records. The doctor must use only their own credentials and booking profile. The Dr Rob Health platform stores the doctor's public Zedmed booking URL only; it must never store Zedmed passwords or secret credentials in frontend code.

4A. Doctor Room fees and PayPal recurring billing

Before authorising PayPal, the doctor will be shown the monthly room rent in Australian dollars. There is one Digital Clinic Room rental arrangement at AUD $299 per month. Only the first 30 days of Digital Clinic Room rent are waived, with no Digital Room setup fee and no rental payment during that period. The first AUD $299 monthly rental payment is charged on day 31, followed by AUD $299 each month. The doctor authorises PayPal to collect the recurring rent until the Doctor Room tenancy is ended under these terms. Zedmed and any other clinic, onboarding, usage or service charges are separate and payable from activation; they are not included in the 30-day Digital Room rent waiver.

A doctor may end the tenancy by submitting the Cancel Rent Room form and giving at least 30 days' notice. The room, professional responsibilities and agreed fees continue during the notice period. When the notice period has ended and Dr Rob finalises the room closure, the platform cancels the linked PayPal subscription. Cancelling an automatic payment directly inside PayPal does not replace the contractual 30-day notice or discharge any fee already due.

A failed, reversed, overdue, suspended or cancelled PayPal payment may restrict or suspend access until the billing issue is resolved. Any change to the assigned price must be communicated before it takes effect and handled in accordance with PayPal's subscription approval and notification process.

4B. Patient consultation payments through Zedmed and Tyro

Patient consultation fees are booked, charged, recorded and reconciled through Zedmed and Tyro, not through the Dr Rob Health PayPal account. The agreed allocation for every completed consultation is 20% to Hallmark Precision Health as the clinic and platform fee and 80% to the treating doctor. Zedmed and Tyro transaction records are the authoritative source for consultation payments, refunds, reversals and settlement. PayPal is used only for the doctor's AUD $299 monthly Digital Clinic Room rent.

5. Grounds for refusal, suspension or removal

A doctor may be refused access, suspended or removed from the platform if any of the following apply:

• The doctor is not currently registered, licensed, insured or legally permitted to practise.
• The doctor provides false, misleading or incomplete registration, clinic, insurance or identity information.
• The doctor harms patients, places patients at unreasonable risk, or ignores patient safety obligations.
• The doctor breaches Australian law, privacy law, health records obligations, advertising rules or professional standards.
• The doctor shares patient data with unauthorised people or allows another person to use their login.
• The doctor uses the platform for unlawful, unsafe, misleading, experimental or non-compliant medical activity.
• The doctor fails to obtain proper patient consent before collecting, reviewing or acting on patient information.
• The doctor fails to review reports personally before releasing advice, treatment suggestions or health recommendations.
• The doctor stores passwords, Zedmed credentials, patient files or private information outside approved secure systems.
• The doctor fails to pay agreed platform fees or breaches the signed agreement.

6. No transfer of access

Doctor room access is personal to the approved doctor or approved clinic users. Login access must not be shared, sold, transferred or used by unauthorised people.

7. Indemnity

The doctor agrees to indemnify and hold harmless Hallmark Precision Health, its owners, directors and officers, every other treating doctor on the platform, and everyone who works for or with Hallmark Precision Health (including staff, locums, contractors and the platform's software developer), from and against any claim, loss, damage, fine or cost — including reasonable legal costs — arising from the doctor's clinical acts or omissions, breach of these terms, breach of any law or professional obligation, or misuse of the platform.

8. Limitation of liability

To the maximum extent permitted by Australian law, Hallmark Precision Health's liability to the doctor is limited to re-supplying the platform service. Hallmark Precision Health, its owners, directors and officers, and the platform's software developer are not liable for any clinical decision, diagnosis, treatment, advice or prescription made by any doctor, or for any indirect or consequential loss arising from use of the platform. The platform's software developer builds and maintains the software only, is not a healthcare provider, and bears no clinical responsibility for any content generated through it.

9. Acceptance

By ticking the box and typing their full name below, the doctor confirms that they understand and accept these terms, including the independent-contractor status, indemnity and limitation-of-liability clauses above, and will comply with the laws of Australia and all professional medical obligations.
