Legal
Terms and Conditions.
Hallmark Precision Health (ABN 51 785 685 944), a private telehealth clinic operating in Victoria, Australia. These terms govern use of this website and patient portal (the "Platform").
1. No doctor-patient relationship until confirmed
Browsing this website, creating an account, or submitting a questionnaire does not, on its own, create a doctor-patient relationship. That relationship begins only once a consultation is confirmed through the clinic's booking process with a specific treating doctor.
2. Not an emergency service
This Platform is not monitored in real time and must never be used for urgent or emergency symptoms. In an emergency, call 000 or attend your nearest emergency department.
3. Educational and decision-support content only
Reports generated through the Platform — including the Biological Age Tracker, the Longevity Stack Assessment, and any automated or AI-assisted draft — are decision-support tools for your treating doctor, not a diagnosis, and are not automatically released to you. Every report is reviewed and approved by a human, AHPRA-registered doctor before publication. Nothing on this Platform replaces individual clinical advice from your own treating doctor.
4. Doctor responsibility
Every doctor providing services through the Platform is an independently practising, AHPRA-registered medical practitioner engaged as a locum or sub-contractor — not an employee or agent of Hallmark Precision Health — and holds their own current medical indemnity insurance. Each treating doctor is solely responsible for their own clinical judgment, diagnosis, advice, treatment decisions, and prescriptions. Hallmark Precision Health provides the digital platform and administrative support only, and does not direct or control any doctor's clinical decisions.
5. Peptides, supplements and unapproved substances
Any peptide, supplement or substance discussed on the Platform is provided for educational purposes and must be discussed with, and approved by, your treating doctor before use. Unapproved, imported or non-pharmacy-sourced substances carry real risks — including contamination, incorrect dosing and interactions — that you assume if you choose to use them outside your doctor's guidance.
6. Limitation of liability
To the maximum extent permitted by Australian law, Hallmark Precision Health, its owners, directors and officers, every treating doctor, and everyone who works for or with Hallmark Precision Health (including staff, locums, contractors and the Platform's software developer) exclude all liability for indirect, consequential or special loss, and limit any liability that cannot be excluded to re-supplying the affected service. Nothing in these terms excludes a guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
7. Indemnity
You agree to indemnify and hold harmless Hallmark Precision Health, its owners, directors and officers, every treating doctor, and everyone who works for or with Hallmark Precision Health (including the Platform's software developer), from any claim, loss, damage or cost arising from your breach of these terms, your misuse of the Platform, or information you provide that is false, incomplete or misleading.
8. The Platform software itself
The Platform is provided on an "as is" and "as available" basis. The developer who builds and maintains the Platform's software is not a healthcare provider, does not review or approve clinical content, and bears no clinical responsibility for any report, recommendation or advice generated through it. The developer's liability in connection with the Platform's operation is excluded to the same extent as set out in clause 6.
9. Third-party services
The Platform links to, or integrates with, third-party services such as 1800MEDICARE / My Health Record, Zedmed, payment processors and wearable-device providers. Hallmark Precision Health does not control and is not responsible for the availability, accuracy or security of those third-party services.
10. Privacy
Your personal and health information is handled in line with our Privacy Policy and the record-access disclaimer presented at registration.
11. Intellectual property
Hallmark Precision Health content and branding, including the Hallmark Precision Health name and logo, may not be copied, reproduced or distributed without written permission.
12. Changes to these terms
These terms may be updated from time to time. Continued use of the Platform after an update constitutes acceptance of the revised terms.
13. Governing law
These terms are governed by the laws of Victoria, Australia, and the parties submit to the exclusive jurisdiction of its courts.
